Terms of Supply

We have set out below our terms and conditions of supply. By placing an order, you agree to and accept these terms and conditions.

2. PRODUCTS

(a) The display of products and prices on the Web Site is an invitation to treat and is not an offer.

(b) The description and specification of products in the Web Site is only approximate and we reserve the right to make changes which do not materially affect the quality or performance of those products.

(c) We may correct any error appearing in the Web Site or withdraw any product from sale without incurring liability. Price and availability is also subject to change without notice.

3. ORDERING PRODUCTS

(a) You may order products from the Web Site by submitting a completed order form through the check out procedure.

(b) Products are subject to availability.

4. THE PRICE AND PAYMENT

(a) The price of the products will be the price quoted in the Web Site at the time you place your order but we reserve the right to correct any errors in pricing and, in this event, you will be entitled to cancel your order or reconfirm it at the correct price. The price will include any applicable value added tax, and the cost of delivery to a UK address. Delivery to an address outside the UK is charged an additional sum based on the method of delivery chosen by the customer.

(b) In addition to the price, you will have to pay our delivery charges as quoted in the Web Site at the time you place your order – unless you qualify for free delivery. The amount of these charges varies according to the delivery address you specify in your order.

(c) Payment is taken from your credit card at the time we accept your order and the billing address for your credit card must be the same as the delivery address. (The credit cards we accept are listed in the Web Site at the time you place your order.) Refunds will generally be made by means of a credit to your credit card.

5. DELIVERY OF PRODUCTS

(a) We will arrange for delivery of the products you order, and we aim to deliver within 28 days of confirmation of your order, to the address which you specify in the check out procedure. However, the time for delivery will not be essential to the contract between us, and we shall have no liability for late delivery. Each product may be individually packaged and despatched and multiple orders may be delivered at different times.

(b) If there is an error or any other delivery problem in respect of the products ordered, you must notify us in writing within 7 days after the delivery date. We will not be liable for any loss or damage if you fail to do this.

6. CANCELLING ORDERS

(a) If you are a consumer you may cancel your order at any time up to 8 working days after your products have been delivered by notifying us by e-mail at info@phyto-power.co.uk or by post at Kingsgate Health Limited, Kingsgate, Main Road, Claybrooke Magna, Lutterworth, LE17 5AJ. The notification should state your order number.

(b) If you cancel your order after we have despatched the products, then you must return the products to us at the address mentioned above without unreasonable delay. The products must be returned in a reasonable condition and at your own expense. We recommend the use of a Recorded Delivery Service. If you do not return the products to us within 30 days of cancelling the contract we may reduce or use your refund to cover the cost of collecting the products.

(c) You can no longer cancel your order once you have opened the product containers or used the products. However, your statutory rights concerning the quality of those products will be unaffected.

7. EXPORT AND CUSTOMS

(a) When ordering products from us, for delivery overseas, you may be subject to import duties and taxes. In that case these charges will be levied when the package reaches your specific destination. Any additional charges for customs clearance will be borne by you as we have no control over such charges and cannot predict what they may be. Customs policies vary from country to country and if in doubt, you should contact your local customs office for a ruling on how your purchase will be treated before you place your order. Please be aware that if you order products from us you are considered to be the importer of record and you must comply with all the laws and regulations of the country in which you are receiving the goods. International customers should be aware that cross border deliveries may be subject to opening and inspection by customs authorities.

8. LIABILITY

(a) We will refund or replace any of our products that may have arrived at the destination in an un-useable or faulty condition or are different from those ordered provided that you notify us within 8 working days of receipt (“the Defect Notification Period”) by emailing info@phyto-power.co.uk. Subject to paragraphs (d) and (e) below this shall be the limit of our liability for defective products. Provided that you have notified us within the Defect Notification Period we will instigate a refund to your credit/debit card of the money paid by you to us for faulty products within 30 days of such notification provided that by that date you have returned the products to us. You will be responsible initially for the cost of returning such products to us unused. If we find that the goods are un-useable or in faulty condition due to our act or default we shall refund to you the reasonable cost of returning them.

 (b) Nothing in this clause shall limit or exclude our liability

 (i) for death or personal injury due to our negligence nor

 (ii) for our fraudulent misrepresentation.

 (c) Nothing in this clause shall limit or exclude our liability under the Consumer Protection Act 1987.

 (d) We shall have no liability for:-

 (i) loss of profits or

 (ii) loss of contracts or

 (iii) indirect or consequential loss or

 (iv) negligence (except as expressly accepted in these conditions)

 (e) If you are a consumer (i.e. not acting in the course of a business) nothing in this clause shall affect your statutory rights.

 (f) If any provision of this clause is found to be illegal, void or unenforceable this shall not affect the validity of the remainder of this clause.
